Mooresville Workers’ Compensation Attorneys Aid Injured Employees

Experienced firm helps North and South Carolina claimants obtain benefits

At Levine Law Group in Mooresville, we are seasoned attorneys who are committed to securing the benefits that employees injured on the job need to boost their health and financial well-being. In the Carolinas, obtaining reimbursement for medical costs, lost wages, rehab expenses and permanent disability starts with completing the necessary forms properly and gathering the necessary supporting materials. If you believe you have been wrongly rejected in a claim for workers’ compensation benefits, we can prepare an appeal and argue for an appropriate resolution during negotiations and hearings.

Lawyers handle claims arising from all types of job accidents

To collect workers’ compensation for an injury, it must be sustained in a workplace accident, such as a vehicle crash or equipment failure, or through repetitive motion injuries, such as carpal tunnel syndrome. If you have suffered a work injury, it’s very important to immediately report your injury to your employer. In most cases, your employer should provide information regarding treatment, but we can assist if they are not abiding by their legal duty.

Advocates help individuals get payment for medical costs and lost wages

In most cases, the law requires your employer or their insurance company to compensate you or your family for injuries or illnesses linked to your job. If you’ve been injured in a work-related accident, we can help you pursue payment for:

  • Medical bills — Reasonable medical costs, including prescription drugs and expenses for transportation to and from doctors’ appointments, are fully funded by an employer’s workers’ compensation coverage. If you have a problem getting a particular treatment paid for or if you’ve been accused of not following medical advice, we will advise you of your rights.
  • Lost wages — While someone is unable to work due to their job-related medical condition, they can receive two-thirds of their average weekly wage up to a limit set annually by each state. For 2020, the maximum weekly payment is $1,066 in North Carolina and $866.67 in South Carolina. These benefits last until the claimant can return to work or has reached maximum medical improvement.
  • Rehabilitation expenses — The effects of an injury might require someone to go through job retraining or undergo some type of vocational rehabilitation so they can go back to work. Both states cover these expenses under the workers’ compensation system.
  • Permanent disability — If an individual’s condition can no longer improve, but they are still fully or partially unable to complete their job duties, disability benefits are available. These payments are also available to people whose injury has led to disfigurement or loss of body part function.
  • Survivor benefits — In the event of a workplace fatality, compensation is provided for funeral expenses, and survivors can collect benefits similar to the wage replacement payments given to living claimants.

You might also be able to recover damages unavailable in a workers’ compensation claim, such as payment for the pain and suffering you experienced, by filing a personal injury suit against a negligent third party, such as a careless driver.

Effective advocates guide clients through the workers’ comp appeals process

Injured employees in the Carolinas can seek reversal of the decision if their workers’ compensation claim is denied. The North Carolina Industrial Commission handles appeals once they are initiated by the filing of Form 33. We assist claimants with this paperwork, the collection of supporting materials and advocacy during mediation and hearings. Likewise, if you’re looking to change the outcome of a claim before the South Carolina Workers’ Compensation Commission, our firm will advocate for your rights.
